Implied Powers:
Powers that are understood and followed and but not written down. Implied powers are harder to have because they are just assumed. Because of this there are fewer implied powers in Congress than expressed powers. The most important implied power Congress has is the "Elastic Clause". This clause is Congress's ability to pass any law that seems to be "necessary and proper." Since the clause "necessary and proper" is such a broad generalization and can be stretched, it can be quite controversial. |
