States that the governmental power lies within the people of America.
Federalism
A system of government in which the the power is divided between a national government and various regional governments. States are granted individual power and responsibilities than the government is.
Separation of Powers
The Separation of the power of the states form the federal government and the division of the three branches of government in which neither branch is more powerful then the other.
Checks and Balances
The powers each branch has to keep in check of the other branches in order for all branches to be equal and no branch can overpower the other.
Judicial Review
The power that the Supreme Court has to declare a law constitutional or unconstitutional.
Limited Government
The United States Constitution, and the Bill of Rights, were written to limit government's role in people's life. Everyone has the right to life, liberty, and property.
Bill of Attainder
A law that establishes guilt and punishes people without a fair trial.
Elastic Clause
Implied power given to Congress. Congress is able to decide which laws are necessary and proper for the United States.
Supremacy Clause
The U.S. Constitution is the ultimate law. Nothing can go against the Constitution.
Writ of Habeas Corpus
Orders that a prisoner be brought to the court so he or she can be determined whether or not they had been lawfully imprisoned and, if not, whether he or she should be released from custody.
Ex Post Facto
Meaning "after the fact" points to laws that were written to restrict behavior that was practiced when it was legal.
Due Process
A constitutional guarantee that all proceedings will be fair and one must have the right to a fair trial and jury before convicted of a crime before their rights are taken away according to the Constitutional amendments.
Expressed Powers
Powers for the U.S. Congress that are written down.
Implied Powers
Powers of Congress that are not written down, but assumed that the Congress has.
Full Faith and Credit
Clause in the U.S. Constitution which states that every state must respect the laws and judgments of other states.
Privileges and Immunities
Clause stated in the U.S. Constitution that no law shall be made that takes the rights of the American citizens away.
Extradition
Surrender of an accused or convicted person by one state or country to another such as deportation.
Republic
A government in which power resides in the citizens able to vote and "ruled" by elected officers and representatives responsible and governing according to law.
